Where Unalaska Bankruptcy Cases Are Filed

All Unalaska bankruptcy cases go to the U.S. Bankruptcy Court for the District of Alaska. There is one federal bankruptcy court in the state, and it sits in Anchorage at 605 W. 4th Ave., Suite 138, Anchorage, AK 99501. The clerk's phone is (907) 271-2655. There is also a toll free line at (800) 859-8059. Office hours are Monday through Friday, 9:00 AM to 12:00 PM and 1:00 PM to 4:30 PM, closed on federal holidays.

Unalaska is one of the most remote cities in Alaska, sitting on Unalaska Island in the Aleutian chain. Travel to the mainland requires a flight. Because of that, most Unalaska residents use the mail or the eSR electronic filing system rather than showing up in person. Mail filings are accepted at the Anchorage address above. Do not send cash. Use a money order or cashier's check made out to the Clerk of Court.

The eSR system, which stands for Electronic Self-Representation, is a free online tool that walks you through the Chapter 7 petition process step by step. It is open 24 hours a day and saves your progress. You must log in at least once every 45 days or your work expires. When done, you submit the package directly through the portal. Find it at the court's eSR page.

Note: Because Unalaska has no local bankruptcy filing office, most residents rely on eSR online filing or mail submission to the Anchorage court.

If a creditor has filed a civil lawsuit against you in Unalaska and obtained a judgment, that record lives at the state court level. It won't be in PACER. To search state court records statewide, use the CourtView public access portal from the Alaska Court System. CourtView is free and covers trial court records going back to 1990 across the state.

PACER is the main federal system for searching bankruptcy case records. You can look up any Unalaska case by debtor name, case number, or attorney. PACER charges $0.10 per page but waives fees for accounts that owe less than $30 in a quarter. Register free at pacer.uscourts.gov or call (800) 676-6856. Electronic filings from January 2000 onward are available. For older cases, you'll need to go through NARA (see below).

The McVCIS line is a free phone option. Call 1-866-222-8029 or the local Anchorage number at (907) 271-2658. You can also try the Alaska toll free line at 1-888-878-3110. McVCIS works around the clock. It reads out debtor name, case number, trustee, filing date, and case status by phone. No account is needed. Just dial and enter the case number or debtor name using the keypad.

Both tools are available from any phone or computer. For Unalaska residents, the McVCIS line is often the fastest way to check whether a bankruptcy was filed without incurring any cost.

Filing Bankruptcy from Unalaska

Before you file, you must complete a credit counseling course from a provider approved by the U.S. Trustee. This must happen within 180 days before you submit your petition. A list of approved providers is at justice.gov. Most courses take one to two hours and are available online, so distance is not a barrier for Unalaska residents. After discharge, a second debtor education course is required.

Chapter 7 filing fee is $338. Chapter 13 is $313. If money is tight, you can ask to pay in installments using Official Form 103A. Chapter 7 filers can request a full waiver using Form 103B if your income is below 150 percent of the federal poverty guidelines.

All filings must carry original signatures. Faxed or scanned copies are not accepted. If you use the eSR portal, the system handles the signature step electronically. If you mail paper documents, sign each page that requires it, and enclose your payment as a money order or cashier's check.

Alaska Bankruptcy Exemptions for Unalaska Residents

Alaska law lets you keep certain property when you file bankruptcy. Under Alaska Statute 09.38.010 through 09.38.510, the homestead exemption is $72,900. That covers equity in your primary residence. The vehicle exemption is $4,050. Tools used in your work or trade are protected up to $3,780. Household goods, clothes, and books together have a $4,050 cap. Your Alaska Permanent Fund Dividend is exempt up to $1,500.

To use Alaska exemptions, you must have lived in Alaska for at least 730 days before filing. That's the rule under 11 U.S.C. § 522(b)(3). Most long-time Unalaska residents qualify easily, but newer workers on the fishing docks or in the seafood industry should check their residency dates. Filing venue under 28 U.S.C. § 1408 requires Alaska to be your domicile for the 180 days before filing or the larger share of the 180 days before that.

Note: You must actively claim Alaska exemptions on your petition schedule or the trustee may treat the property as available to pay creditors.
