Alaska Exemptions for Bethel Census Area Filers

Residents of the Bethel Census Area who file bankruptcy can use Alaska's state exemptions under Alaska Statute 09.38.010 through 09.38.510 if they have lived in Alaska for at least 730 days. That is the two-year residency requirement from 11 U.S.C. § 522(b)(3). The Alaska homestead exemption is $72,900, much higher than the $31,575 federal option. The vehicle exemption is $4,050. Household goods, clothing, and books get $4,050 in protection. Tools of the trade are covered up to $3,780. The Permanent Fund Dividend is exempt up to $1,500 per person. Alaska offers no wildcard exemption.

Many Bethel area residents have subsistence-related property, fishing gear, and tools tied to their livelihoods. The tools-of-trade exemption may provide some protection for smaller equipment. Property worth more than the exemption limit can be at risk in a Chapter 7 case. In Chapter 13, you keep your property but agree to a repayment plan.

The 180-day venue rule under 28 U.S.C. § 1408 requires you to have lived in Alaska or had your main business or assets here for the 180 days before filing. Alaska was the first state to enact a domestic asset protection trust law in 1997 under AS 34.40.110. These self-settled trusts carry a four-year fraudulent transfer look-back under state law. The Alaska Public Records Act at AS 40.25 governs state and municipal records but does not apply to federal bankruptcy court files.
